Planning for Nursing Home Care

Much of our elder law practice involves helping people pay for nursing home care while enabling them to preserve as many of their assets as possible.

This is a very complex area of the law which requires a careful analysis and judicious action. If you make the wrong move, you can incur significant financial penalties. Our attorneys understand the legal and tax implications of transferring assets and can help you make the decisions which are right for you.

Usually, this means transferring assets over time in order to qualify for Medicaid which can then pay for nursing home care. Other options exist however, including the use of private long-term care insurance and veteran's benefits or a combination of funding sources.

In many cases, it may be preferable to handle financial or health care decisions by assigning a power of attorney to a trusted family member. This can reduce the legal costs and personal efforts that will be required compared to a conservatorship or guardianship. In other cases, it can make sense to provide for the needs of an elderly person using a conservatorship or guardianship.
