Legal Issues in Same Sex Divorce
The issues in the dissolution of a civil union or same sex marriage are largely the same as in a traditional divorce, with some exceptions. Marital property and debts must be divided and possible issues of spousal support determined. If there are children in the marriage or civil union, issues of child custody and visitation must be determined. In most cases, these issues are straight-forward, and our firm will work to resolve them quickly and efficiently.
Child custody and visitation matters can be complicated however — for example, when a parent from a previous marriage has visitation rights. Same Sex Marriage in Connecticut
Following a ruling by the Connecticut Supreme Court in November 2008, same sex marriage was legalized. The ruling also recognized the marriages of same sex couples from other states.
Civil unions created before November 2008 will still be recognized until October 1, 2010. If those unions are still in existence on that date, the couples in those unions will be automatically be considered married on and after that date.
